Understanding Probate in Wales
When you lose someone, there’s a lot to deal with emotionally and then suddenly there’s paperwork, banks, property, forms, and decisions. It’s normal to feel unsure where to begin. Most people do.
Probate is one of those words you often hear at a time when your head already feels full. So let's break it down
What is probate?
Probate is the official process of sorting out a person’s affairs after they have passed away.
It allows someone, usually a close family member, to:
-
Access bank accounts
-
Deal with property
-
Pay any outstanding bills
-
Make sure money and belongings go to the right people
If there is a Will, this confirms who has the legal authority to manage things.
If there isn't a Will, there’s still a legal process to follow; it just works slightly differently.
That’s essentially it. Just a formal step to make sure everything is handled properly and fairly.
When is probate needed?
You may need probate if the person:
-
Owned a home or property in their own name
-
Had savings or investments worth more than a few thousand pounds
-
Held accounts where the bank asks for a Grant of Probate
If everything was jointly owned with a spouse or partner, probate isn’t always required.

What does the probate process involve?
While every family’s circumstances are different, it usually involves:
-
Checking whether there's a Will
-
Gathering details about finances, property, debts and assets
-
Completing any necessary tax forms
-
Applying for probate
-
Once granted, collecting funds, settling bills and sharing what's left
Straightforward estates often take around 3 to 6 months.
More complex situations can take longer.
